Model Practice Directives - Overview

To support tribunals in implementing the Administrative Tribunals Act (ATA), the AJO is developing models or precedents of various documents that may be common to a number of tribunals. If a tribunal chooses, it may adapt the model to suit the tribunal's unique needs and specific statutory provisions.

The first of those documents, model practice directives under section 12 and 13 of the ATA, are set out below.

Section 12 requires practice directives estimating the usual time period for the tribunal to complete an application and the various procedural steps within an application, as well as the usual time period for release of the tribunal's final decision and reasons.

Section 13 authorizes the tribunal to issue other practice directives that are consistent with the ATA and the tribunal's enabling legislation.

Sections 12 and 13 also require that practice directives issued under these sections be made accessible to the public.

These models were developed with input from various tribunals and the AJO would like to thank the chairs and staff of those tribunals for their very helpful insights and comments.
