Sanctions with Imminent Danger to Physical Health
Overview
Effective: March 31, 2009
The purpose of the legislative provision establishing this hardship category is to create a legislative discretion that enables the Minister to provide hardship assistance in appropriate cases to family units that are ineligible for income assistance or disability assistance due to the application of a sanction in relation to a conviction or a judgment.
When a family unit is ineligible for income assistance or disability assistance due to a sanction in relation to a conviction or judgment, the Minister may provide hardship assistance if failing to issue hardship assistance would result in:
- the family unit experiencing undue hardship, AND
- the physical health of a person in the family unit being in imminent danger.
This hardship category is available to applicants and recipients under the Employment and Assistance Regulation and the Employment and Assistance for Persons with Disabilities Regulation.
