Determining Eligibility for Hardship Assistance under Sanction: September 23, 2010
September 23, 2010To determine eligibility for an applicant who has a sanction in relation to a conviction or a judgment on their case and is reapplying for assistance due to undue hardship and imminent danger to physical health, follow these steps:
| EAW | 1. | Assess basic financial eligibility for assistance. |
| EAW | 2. | If Sanction Code 4 or 5 exists, forward applicant’s case to Supervisor. |
| Supervisor | 3. | Verify the accuracy of the information and documentation provided by the applicant that describes applicant’s health condition and forward the case to the Manager. |
| Manager | 4. | Determine if hardship will occur if applicant does not receive assistance based on information and documentation provided by the applicant. |
| Manager | 5. | If decision is made that the family unit is eligible for hardship assistance, make a note of the decision with written rationale and assess duration of assistance required based on applicant’s medical condition. |
| Manager | 6. | Request PLMS Supervisor of Criminal Investigations (SCI) to apply the resolve code. |
| PLMS SCI | 7. | Apply resolve Code 8 to override the sanctions code and enter an INV alert message “Client has sanction due to conviction or judgment but undue hardship and health is in imminent danger. Notify PLMS if family unit changes.” Communicate to Manager when completed. |
| Manager | 8. | Return the case with any specific directions to supervisor who, in turn, returns the case to EAW for action. |
| EAW | 9. | Issue hardship assistance. If issuing hardship under this category and PPIM has specified less than 15 months to be issued, change end date of ongoing hardship on the system. Notify applicant. |
| Supervisor | 10. | Notify applicant of decision and advise of their right to reconsideration if it is determined that no undue hardship and imminent danger to physical health exists. |
| EAW | 11. | Notify PLMS of case closure or if the family unit is no longer eligible for hardship assistance. |
| PLMS SCI | 12. | If the case closes or if the family unit is no longer eligible for hardship assistance, reapply the sanction code. |

Review of Hardship Eligibility: May 20, 2010
May 20, 2010The Manager will set an end date for the hardship assistance. This will vary depending on the circumstances of the case but will not exceed 15 months.
The case must be reviewed and the extension approved by the Manager before extending hardship assistance term past 15 months.
