Disqualification for Fraud and Related Offences


Overview

Hardship assistance is provided to meet the essential needs of families with dependent children who are ineligible for income assistance or disability assistance for one of the following reasons:

  • A three-month disqualification for fraud or a related offence that was imposed under the BC Benefits legislation, but not yet fully served under that legislation, is now being applied under the new legislation.
  • A fraud sanction of three months of ineligibility has been imposed under the Employment and Assistance (EA) Act or Employment and Assistance for Persons with Disabilities (EAPWD) Act for fraud or a related offence, occurring entirely under the BC Benefits legislation. This may be due to a Criminal Code conviction, conviction under the EA or EAPWD Act, obtaining a civil court judgement, or signing of an acknowledgement in regard to assistance under the BC Benefits legislation.

Hardship assistance is provided on a temporary basis, for only one month at a time. Eligibility for hardship must be re-established each month.

Disqualification for Fraud and Related Offences is available to applicants and recipients under the Employment and Assistance Regulation and Employment and Assistance for Persons with Disabilities Regulation.
