Hardship assistance is provided on a temporary basis, for only one month at a time. If further hardship assistance is required, eligibility must be re-established each month.

Hardship assistance issued under Disqualification for Fraud and Related Offences is available to families with dependent children who are ineligible for income assistance or disability assistance because they meet one of the following conditions:

  • under section 44 of the Employment and Assistance (EA) Act or section 35 of the Employment and Assistance for Persons with Disabilities (EAPWD) Act, they have to serve the remaining portion of a three-month disqualification imposed under the BC Benefits legislation
  • under section 38 of the EA Act or section 28 of the EAPWD Act, they are subject to a three-month period of ineligibility for fraud or related offences that occurred entirely under the former legislation, but the conviction, civil court order or acknowledgement occurred under the current legislation

Hardship assistance issued under this category is repayable. [see Related Links – Sanctions]

Once the hardship reason no longer exists, cases must be re-assessed to determine if the family unit meets the eligibility criteria for income assistance or disability assistance.
