The Employment and Assistance Act and the Employment and Assistance for Persons with Disabilities Act authorizes the ministry to recover certain types of assistance issued to or on behalf of clients.

Assistance may be recovered in any of the following circumstances:

  • assistance issued while the client is awaiting income from other agencies

  • assistance issued where there was no eligibility

  • supplements that are repayable by regulation were issued

  • hardship assistance that is repayable by regulation were issued

The ministry records and takes action to recover assistance in any of the following ways:

  • assignment of or consent to deduct future income from another source

  • repayment of assistance that was issued

  • notification of overpayment

  • a promise to pay agreement

Employment and Assistance Workers and Investigative Officers must fully explain the procedures that are authorized under the Employment and Assistance Act and the Employment and Assistance for Persons with Disabilities Act in specific situations for recovering assistance.

Cases of potential overpayment of assistance due to alleged spousal or dependency relationships are referred to regional Prevention and Loss Management Services (PLMS).

The earnings exemptions outlined in Schedule B and allowable asset levels of the EA and EAPWD Regulation must be considered when calculating overpayments.
